This Service Agreement ("Agreement") governs the terms under which you ("Customer") engage Miko Collectibles and Analytics LLC, operating under the brand Epicardz ("the Company"), to facilitate the sale of items. By submitting this form, you agree to the terms outlined in this Agreement. The Customer acknowledges that the Company acts solely as a service-based broker and does not operate as a physical warehouse or shipping hub.
The Customer is responsible for shipping items directly to the designated Fanatics (formerly PWCC) facility. The Company does not take physical possession, custody, or control of any items at any point in the process. Consequently, the Company is not liable for any loss, theft, or damage that occurs during transit or while items are held by Fanatics. Any claims regarding the physical condition or loss of items must be handled between the Customer, the shipping carrier, and/or Fanatics.

The Company's role is strictly limited to administrative curation, account management, and facilitation of the auction listing on the Fanatics platform. The Customer warrants that all items provided are authentic and unaltered. If an item is rejected by Fanatics for authenticity or condition issues, the Customer is responsible for all associated return shipping costs and any administrative penalties assessed by Fanatics.
The Company will adhere to the payout percentages and calculation rules as displayed on the Epicardz Weekly Auction Submission Form. By submitting this form, the Customer acknowledges and agrees to these established rates. Payment will be made via the option the Customer selected in the form. All third-party transaction fees (including but not limited to Wire fees, PayPal fees, or Wise conversion fees) will be deducted from the final payout.
Payments for sold items will be made on the Friday following the release of funds from Fanatics. The Company is not responsible for delays caused by Fanatics' internal payout cycles or buyer non-payment.
If an item goes unpaid, the Customer will be notified. If the Customer does not submit a request to withdraw or reschedule the card within 48 hours, it will be listed in the next available auction block by default.
Should the Customer choose to withdraw a card after it has been processed or after an unpaid auction, the Customer will be responsible for all withdrawal fees, storage fees, and return shipping costs as determined by Fanatics.
The Company is a service provider only and provides no insurance for the Customer's property. The Company shall not be held liable for technical errors on the Fanatics platform, market price fluctuations, or the financial status of the auction house.
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. Each party expressly consents to the jurisdiction of the courts of North Carolina for any litigation arising from this Agreement.
