WEBSITE TERMS & CONDITIONS
1. Acceptance of Terms
By accessing and using the EpiCardz website and services (operated by Miko Collectibles and Analytics LLC), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services. EpiCardz is a brand of Miko Collectibles and Analytics LLC.
2. Use of Services
EpiCardz provides a consignment marketplace platform for trading cards. Users must be at least 18 years old or have parental consent to use our services. You agree to provide accurate information and maintain the security of your account credentials.
3. Consignment Terms
All items consigned through EpiCardz remain the property of the consignor until sold. EpiCardz acts as an agent to facilitate sales. Commission rates and payout terms vary by consignment program and are disclosed prior to consignment acceptance.
4. Listing Accuracy
While we strive to provide accurate descriptions and images of all listed items, EpiCardz does not guarantee the accuracy of third-party grading services or card authenticity. Buyers are encouraged to review all available information before purchase.
5. Payment and Fees
Payment terms, processing fees, and commission structures are disclosed at the time of consignment or purchase. EpiCardz reserves the right to modify fee structures with 30 days notice to active consignors.
6. Shipping and Insurance
Consignors are responsible for shipping items to EpiCardz according to provided instructions. Insurance recommendations will be provided based on item value. EpiCardz is not liable for items lost or damaged during consignor shipping.
7. Limitation of Liability
EpiCardz shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
8. Intellectual Property
All content on the EpiCardz website, including logos, designs, text, and images (excluding user-submitted content), is the property of EpiCardz and protected by copyright laws. Unauthorized use is prohibited.
9. Modifications to Terms
EpiCardz reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms. Material changes will be communicated via email to registered users.
MIDDLEMAN SERVICE TERMS & CONDITIONS
The following terms apply to all middleman transactions facilitated by Miko Collectibles & Analytics LLC, doing business as EpiCardz. By participating in any middleman service — whether as a Buyer or Seller — you agree to the applicable terms below.
FOR BUYERS
By submitting payment or authorizing a transaction, Buyer agrees that Miko Collectibles & Analytics LLC, doing business as EpiCardz, acts solely as a middleman and not as the seller or owner of any item.
All transactions are final with no returns, refunds, or chargebacks permitted. EpiCardz makes no guarantees regarding authenticity, condition, grading outcomes, sealed product contents, manufacturer defects, or future value, and any inspection performed is limited to basic visual review only.
Buyer is responsible for shipping costs and selection, and all risk of loss transfers to Buyer once the item is tendered to the carrier. Any shipping insurance purchased is obtained by EpiCardz solely as agent for Buyer, with Buyer as the insured party and beneficiary, and EpiCardz does not guarantee claim approval, payout, replacement, or reimbursement.
EpiCardz is not liable for carrier delays, loss, or damage, sealed product risks, or market fluctuations, and its total liability shall not exceed the service fees paid. Buyer agrees not to initiate chargebacks once services begin.
This agreement shall be governed by the laws of the State of North Carolina.
FOR SELLERS
By consigning or submitting items, Seller agrees that Miko Collectibles & Analytics LLC, doing business as EpiCardz, acts solely as a middleman and sales agent and does not guarantee sale price, timing, market value, or buyer demand. Seller represents and warrants that all items are authentic, lawfully owned, free of liens or encumbrances, and accurately described, and that Seller bears full responsibility for authenticity, originality, and condition. EpiCardz may perform basic visual inspection but does not authenticate, grade, or assume liability for undiscovered defects, altered items, or manufacturer issues.
Seller authorizes EpiCardz to list, market, negotiate, and complete sales on Seller's behalf and to deduct agreed-upon fees, commissions, and applicable costs from sale proceeds. Payments made to Seller represent the transfer of proceeds from the sale of Seller's property, net of applicable service fees, and do not constitute compensation for services rendered to EpiCardz. Seller is solely responsible for reporting any income arising from such sales to applicable tax authorities, and EpiCardz does not assume responsibility for Seller's tax reporting obligations. Seller agrees to provide accurate identifying and tax-related information (including Form W-9 upon request) for compliance and recordkeeping purposes.
Payout will be issued to Seller net of fees within the stated payout window after funds clear. All sales are final once completed, and Seller is not entitled to refunds, returns, or chargebacks. Seller agrees not to initiate chargebacks or disputes. EpiCardz is not responsible for carrier delays, loss, or damage during transit, and shipping risk transfers once items are tendered to the carrier. EpiCardz's total liability shall not exceed the service fees earned on the transaction.
Nothing in this Agreement shall be construed as creating an employment, partnership, or independent contractor relationship between EpiCardz and Seller. This Agreement shall be governed by the laws of the State of North Carolina.
